1. Agreement to These Terms

Welcome to Bude Guest House ("Bude Guest House," "we," "our," or "us").

These Terms and Conditions ("Terms") govern your access to and use of our website, social media pages, online booking services, and any related applications or services (collectively, the "Website"), as well as any reservation or stay at Bude Guest House.

By accessing our Website, making a reservation, or staying at our property, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Website or make a reservation with us.

These Terms form a legally binding agreement between you and Bude Guest House.

2. Definitions

For the purposes of these Terms:

  • "Bude Guest House," "we," "our," or "us" refers to Bude Guest House, its owners, employees, agents, and authorized representatives.

  • "Website" means our website, booking platform, social media pages, and any related online services operated by or on behalf of Bude Guest House.

  • "Guest," "you," or "your" means any person who accesses our Website, makes a reservation, or stays at Bude Guest House.

  • "Reservation" or "Booking" means any confirmed or pending accommodation reservation made through our Website or any authorized booking platform.

  • "Property" means Bude Guest House and all of its facilities, guest rooms, common areas, parking areas, and amenities.

3. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices, legal requirements, or services.

When we make changes, we will update the "Last Updated" date at the top of this document. Any revised Terms become effective immediately upon publication unless otherwise stated.

Your continued use of the Website or continued booking of our services after changes are posted constitutes your acceptance of the revised Terms.

4. Website Use

The Website is provided to offer information about Bude Guest House, our accommodations, services, pricing, availability, and booking options.

You agree to use the Website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the Website for fraudulent or unlawful purposes;

  • interfere with the security or operation of the Website;

  • attempt to gain unauthorized access to our systems;

  • upload viruses, malware, or harmful software;

  • use automated software, bots, scrapers, or similar technologies to access the Website without our written permission;

  • copy, reproduce, or commercially exploit any part of the Website except as permitted by law or with our written consent.

We reserve the right to suspend or terminate access to the Website for any user who violates these Terms.

5. Eligibility

You must be at least 18 years old to make a reservation at Bude Guest House.

Guests under the age of 18 may stay only when accompanied by a parent, legal guardian, or another responsible adult authorized to supervise them.

By making a reservation, you represent that:

  • you are legally capable of entering into a binding agreement;

  • all information you provide is true, accurate, and complete;

  • you are authorized to use the payment method provided;

  • you will comply with these Terms during your use of the Website and your stay.

6. Intellectual Property

Unless otherwise stated, all content on the Website, including text, photographs, logos, graphics, videos, designs, software, and other materials, is owned by or licensed to Bude Guest House and is protected by applicable intellectual property laws.

You may access and view the Website for your personal, non-commercial use only.

You may not, without our prior written permission:

  • copy or reproduce Website content;

  • modify or create derivative works;

  • distribute, publish, sell, license, or commercially exploit any content;

  • remove copyright, trademark, or proprietary notices.

Nothing in these Terms grants you ownership of any intellectual property belonging to Bude Guest House.

7. User Representations

By using the Website or making a reservation, you represent and warrant that:

  • All information you provide is accurate, complete, and current.

  • You will promptly update any information that changes.

  • You will not use the Website for any unlawful, fraudulent, or misleading purpose.

  • You will not violate any applicable laws or regulations.

  • You will not attempt to disrupt the operation or security of the Website.

  • You understand that information provided on the Website is for general informational purposes and may change without notice.

  • You are responsible for ensuring that your travel documents, visas, health requirements, and any applicable government entry requirements are satisfied before traveling to Haiti.

  • Bude Guest House is not responsible for losses arising from government travel restrictions, airline cancellations, visa denials, border closures, weather events, civil disturbances, or other circumstances beyond our reasonable control, except where required by applicable law.

8. Rates, Taxes, and Payment

Unless otherwise stated, all room rates are quoted in the applicable currency and are subject to any taxes, fees, or government charges required by law.

We reserve the right to correct pricing errors, typographical mistakes, or inaccuracies at any time. Such corrections will not affect confirmed reservations unless the error was obvious or resulted from a technical malfunction.

Accepted methods of payment may vary and will be communicated during the booking process or upon arrival.

9. Check-In and Check-Out

Guests must comply with the published check-in and check-out times unless otherwise agreed in writing by Bude Guest House.

Guests may be required to present a valid government-issued photo identification and, where applicable, the payment card used to secure the reservation.

Early check-in or late check-out may be available upon request but is not guaranteed and may be subject to additional charges.

Failure to check out by the agreed departure time may result in additional fees.

Check-in begins at 3:00 PM, and check-out is at 11:00 AM. If you remain past 11:00 AM without notifying us and obtaining our permission, we reserve the right to charge you for the additional days.                                             10. Guest Responsibilities and House Rules

To ensure a safe and comfortable environment for all guests, you agree to:

  • Treat staff, other guests, and neighbors with courtesy and respect.

  • Keep guest rooms and common areas reasonably clean and orderly.

  • Comply with all posted safety instructions and property rules.

  • Respect quiet hours established by the property.

  • Use the property's facilities and equipment responsibly.

  • Supervise children under your care at all times.

  • Ensure that visitors comply with these Terms and any house rules.

Guests must not:

  • Engage in illegal activities on the property.

  • Damage, misuse, or remove property belonging to Bude Guest House.

  • Disturb other guests through excessive noise or disruptive behavior.

  • Bring hazardous, flammable, or illegal substances onto the property.

  • Interfere with the safety, security, or enjoyment of other guests.

Bude Guest House reserves the right to refuse service or require a guest to leave the property without refund if the guest's conduct threatens the safety, comfort, or property of others, or materially violates these Terms or applicable laws.

11. Damage to Property

Guests are responsible for any damage caused by themselves, members of their party, or their visitors, whether intentional or resulting from negligence.

This includes damage to guest rooms, furnishings, fixtures, appliances, linens, keys, locks, and any other property belonging to Bude Guest House.

Where permitted by applicable law, we reserve the right to recover the reasonable costs of repair, replacement, cleaning, or other losses resulting from such damage.

Normal wear and tear is excluded.

12. Health and Safety

Guests are expected to exercise reasonable care while using the property and its facilities.

You agree to follow all posted safety instructions, emergency procedures, and reasonable directions given by our staff.

If you become aware of a safety hazard or emergency during your stay, you should notify a member of staff as soon as reasonably possible.

13. Force Majeure

Bude Guest House shall not be liable for any delay, interruption, or failure to perform its obligations where such failure results from events beyond its reasonable control.

Such events may include, but are not limited to:

  • Natural disasters;

  • Hurricanes, floods, earthquakes, or severe weather;

  • Fire or utility failures;

  • Government actions or restrictions;

  • Civil unrest, riots, or acts of terrorism;

  • Epidemics or pandemics;

  • Transportation disruptions;

  • Labor disputes; or

  • Any other event beyond our reasonable control.

Nothing in this section limits any rights you may have under applicable law.

14. Third-Party Websites

Our Website may contain links to third-party websites or services for your convenience.

These websites are operated independently from Bude Guest House, and we do not control or endorse their content, products, services, or privacy practices.

Your use of any third-party website is at your own risk and subject to that website's own terms and policies.

15. Privacy

Your use of our Website and services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information.

By using our Website or making use of our services, you acknowledge that you have read and understood our Privacy Policy.

16. Disclaimer

The information provided on our Website is made available in good faith for general informational purposes.

While we strive to keep information accurate and current, Bude Guest House makes no guarantees or warranties regarding the completeness, accuracy, reliability, availability, or suitability of the information provided.

To the fullest extent permitted by applicable law, your use of the Website and our services is at your own risk.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Bude Guest House, its owners, employees, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • your use of the Website;

  • your stay at the property;

  • temporary service interruptions;

  • loss of personal property, except where caused by our negligence or where liability cannot legally be excluded; or

  • events beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

18. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Haiti.

Any dispute arising out of or relating to these Terms or your use of the Website or services shall be subject to the jurisdiction of the competent courts of Haiti, unless applicable law provides otherwise.

19. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.

20. Entire Agreement

These Terms and Conditions, together with any policies expressly incorporated by reference, constitute the entire agreement between you and Bude Guest House regarding your use of the Website and related services and supersede any prior understandings relating to the same subject matter.

USER REPRESENTATIONS By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms and Conditions; (4) you are not under the age of 13 and using this Site without your parents or guardian permission; (5) not a minor in the jurisdiction in which you reside; if a minor, you have received parental permission to use the Site; (6) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (7) you will not use the Site and Bude Guest House for any illegal activities or unauthorized purpose; (8) your use of the Site will not violate any applicable law or regulation. (9) All material and information presented by Bude Guest House is intended to be used for informational purposes only. (9) You will do your own research on the safety and situation of the country or the city that you are traveling before booking. Bude Guest House is not bound to keep you inform or cancel a reservation for a full refund based on "not knowing" in advance. Please consult with your appropriate legal representation regarding your stay and travel.

Service Interruptions and Unforeseen Events
 

Service Availability

 

We make reasonable efforts to provide its services reliably and continuously. However, uninterrupted service cannot always be guaranteed.

 

Services may be temporarily unavailable, delayed, limited, or interrupted because of circumstances that are beyond our reasonable control.

 

These circumstances may include, without limitation:

 

* Electricity or power outages;

* Internet, telephone, cellular, or telecommunications failures;

* Fuel shortages or transportation disruptions;

* Damage to infrastructure;

* Severe weather, hurricanes, flooding, earthquakes, or other natural events;

* Civil unrest, demonstrations, violence, or security incidents;

* Government actions, restrictions, or changes in applicable laws;

* Public-health emergencies;

* Cyberattacks, system failures, or failures of third-party providers;

* Shortages of personnel or resources resulting from circumstances beyond our reasonable control; and

* Other events that could not reasonably have been anticipated or prevented.

 

  • Conditions Affecting Service in Haiti

 

Because infrastructure and operating conditions may vary, services provided in Haiti may occasionally be affected by circumstances such as electricity interruptions, telecommunications outages, road or transportation disruptions, fuel availability, weather conditions, security concerns, civil unrest, or other local conditions.

 

When such circumstances occur, bude guest house will make reasonable efforts to maintain or restore services. However, the Company does not guarantee that services will remain available during such events or that they will be restored within a particular period.

 

  • Force Majeure

 

Bude guest house will not be considered in breach of these Terms & Conditions, and will not be responsible for a failure or delay in performing its obligations, to the extent that the failure or delay results from an event or circumstance beyond its reasonable control.

 

This provision does not eliminate any rights or obligations that cannot legally be excluded under applicable law.

 

During emergencies or infrastructure failures, advance notice may not always be possible.

 

  • Restoration of Services

 

When an interruption occurs, we will use reasonable efforts to resume normal operations when conditions permit.

 

Any estimated restoration time provided would be for informational purposes only and is not a guarantee.

 

  • Refunds, Credits, and Compensation

 

Unless otherwise expressly stated in the applicable service agreement or required by law, a service interruption caused by circumstances beyond Bude guest house's reasonable control does not automatically entitle a customer to a refund, credit, reimbursement, or other compensation.

 

Where appropriate, we may voluntarily provide a credit, refund, extension, or other remedy based on the circumstances and the applicable service terms.

 

  • Customer Responsibility

 

Customers are responsible for maintaining reasonable alternative arrangements where continued access to the service is important to them.

 

Customers should also ensure that their contact information is current so that we can communicate important service-related information when possible.

 

  • No Guarantee of Continuous Availability

 

Nothing in these Terms & Conditions should be interpreted as a promise that the service will always be available, uninterrupted, error-free, or accessible from every location.

 

We will nevertheless make reasonable efforts to provide dependable service and respond appropriately when unexpected disruptions occur.

 

  • Limitation of Liability

 

To the maximum extent permitted by applicable law, we will not be liable for losses, delays, or damages resulting solely from an interruption or limitation of service caused by circumstances beyond the Company's reasonable control.

 

Nothing in these Terms & Conditions excludes or limits liability where doing so would be prohibited by applicable law.

 

Bude guest house may update these Terms & Conditions from time to time. The most current version will be made available through our website.

 

Continued use of the service after an updated version becomes effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

  • If a guest leaves earlier than the originally reserved period for a reasonable and valid reason, a 50% discount may be applied to the remaining reserved days only. This adjustment is intended to help offset the potential loss associated with the reserved space remaining unavailable for rebooking. Eligibility is subject to management approval.
